Chapter 11 Bankruptcy Reorganizations

Our firm has substantial experience in all aspects of Chapter 11 business bankruptcy cases. The firm regularly appears in Chapter 11 cases of large privately held companies as well as publicly traded corporations as counsel for the debtor, the creditors' committee, trustee, major creditors, or principals in their individual capacity. Members of the firm also serve as Chapter 11 trustees.

Workouts and Business Restructuring

Our firm represents debtors, principals, purchasers, and creditors in connection with business reorganization and workouts. We work with our clients and their business, financial, and accounting consultants to determine whether there are viable alternatives to Chapter 11 proceedings. We are skilled in seeking creative, consensual solutions to problems and disputes, while being prepared to assert our client's rights zealously when fair compromise is not possible.

Bankruptcy Litigation

Our firm represents clients in connection with virtually any litigation matters in bankruptcy cases, including defending or prosecuting preference claims, defense or prosecution of suits to recover fraudulent transfers, enforcement or lifting of the automatic stay, defense or prosecution of suits to recover assets for the bankruptcy estate, and objecting to or supporting plans of reorganization and sales of assets.

General Business Bankruptcy and Insolvency

Our firm provides a wide variety of general business bankruptcy and insolvency services such as filing of Chapter 7 cases for businesses, filing Chapter 7 or 13 cases for individuals with substantial personal debts arising as a result of a business or tax problem, representation of Chapter 7 trustees, representation of receivers in federal and state court, the windup of corporate or other limited liability entities outside of bankruptcy, representation of parties interested in purchasing assets or stock of a bankrupt debtor, and representing unsecured and secured creditors, shareholders, officers, directors, partners, and managing members in bankruptcy cases. One or more attorneys with the firm has been on the Chapter 7 panel of trustees since 1987.

Creditor's Rights

Our firm assists owners and lessors of personal property, general trade creditors, and landlords in enforcing their rights in accordance with applicable state and federal law. Services rendered to assist these clients include the filing of collection suits, collection and domestication of judgments, and enforcement of rights under loan and lease documents, including real and personal property foreclosures, recovery of leased equipment, and presentation of deficiency claims. The firm successfully litigated the enforceability of "hell or high water" claims in commercial lease transactions in Georgia.

Business and Commercial Litigation

Our firm regularly represents clients in a wide variety of litigation matters involving commercial disputes in federal and state trial and appellate courts throughout Georgia.

Business Law

Our firm advises business clients in all aspects of their business operations. These services include: selection of appropriate business form (corporation, limited liability company, partnership etc.), purchase and sale of business, corporate governance, bridge loans and equity investments, employer-employee relations, franchise law, non-competes, consulting agreements, operating leases and contracts.

Commercial Real Estate

Our firm has a substantial transactional practice in commercial real estate matters such as the purchase and sale of real property, drafting of contracts and leases, foreclosure of real property, and documentation of real estate transactions. The firm is an agent for Lawyers Title Insurance Corporation.

Domestic Relations

Our firm represents clients in all domestic matters, such as divorce and separation proceedings, drafting of prenuptial agreements and custody disputes.
